Wine Enthusiast’s Blitzen Caption Contest Official Rules

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT IMPROVE YOUR CHANCES OF WINNING.

1. HOW TO ENTER: Visit www.WineEnthusiast.com/Contest and fill in the information on the page no later than 11:59 p.m. EST December 19, 2008. Limit one (1) entry per person or email address. No mechanically reproduced entries, alterations, facsimiles or forged entries. All contest submissions become the sole and exclusive property of Wine Enthusiast (“Sponsor”) and receipt of entries will not be acknowledged or returned. Sponsor is not responsible for technical, hardware or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic or other communications or transmission and/or other computer error. Sponsor, in its sole discretion, reserves the right to disqualify any person who tampers with the entry process or the operation of the web site, or who otherwise violates these rules. Wine Enthusiast reserves the right to modify scheduling of the contest without prior notice. Winners will be selected by a member or members of the staff of Wine Enthusiast (the “Judge(s)”). All decisions of the Judge(s) are final and binding. In case of duplication the entry with the earliest email submission date will be declared the winner.

2. Start/End Times. Contest begins on November 17, 2008 and ends at 11:59 p.m. ET on December 19, 2008.

3. ELIGIBILITY: Participation open only to legal residents of the fifty United States or the District of Columbia who are 18 years or older as of the date of entry. Employees, officers and directors and their immediate family members (mother, father, sister, brother, son, daughter and spouse) or members of the same household (whether related or not) of Wine Enthusiast (“Sponsor”) are NOT ELIGIBLE to enter. Limited to one prize per person.

4. VOID WHERE PROHIBITED BY LAW: This contest is void wherever prohibited, taxed or restricted by law and is subject to all federal, state and local laws and regulations.

5. PRIZE: One (1) Grand Prize consists of one Wine Enthusiast Silent 16 Bottle Wine Refrigerator (SKU #: 272 02 17. Approximate Retail Value (ARV): $194.95). Five (5) First Place prizes consists of one $50 Wine Enthusiast Gift Certificate (Approximate Retail Value (ARV) $50).

Total approximate retail value of all prizes combined: $444.95. Prizes are non-transferable. No substitutions or cash redemptions. In the case of unavailability of any prize, Sponsor reserves the right to substitute a prize of equal or greater value.

6. NOTIFICATION: Winners will be notified via e-mail and may be required to sign and return, where legal, an Affidavit of Eligibility and Liability/Publicity Release within seven (7) days of prize notification. If any winner cannot be contacted by email within five (5) calendar days of first notification attempt, if any prize or prize notification is returned as undeliverable, or in the event of noncompliance with these Sweepstakes rules and requirements, such prize will be forfeited and an alternate winner will be selected from all remaining eligible entries. Upon prize forfeiture, no compensation will be given. The prize winners’ names will be posted on our site at www.wineenthusiast.com.

7. USE OF DATA: Sponsor will be collecting personal data about entrants online, in accordance with its privacy policy. Please review the Sponsor’s privacy policy at http://www.wineenthusiast.com/Services/privacy.asp. By participating in the Contest, entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s privacy policy.

8. CONDITIONS: By participating, entrants and winners agree to release and hold harmless Sponsor, its advertising and promotion agencies and their respective parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors, from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with, participation in Sweepstakes, or possession, acceptance and/or use or misuse of prize or participation in any Sweepstakes-related activity and for any claims based on publicity rights, defamation or invasion of privacy and merchandise delivery. Sponsor is not responsible if Sweepstakes cannot take place or if any prize cannot be awarded due to delays or interruptions due to acts of God, acts of war, natural disasters, weather, acts of terrorism or other event outside the reasonable control of Sponsor. Further, Sponsor reserves the right in its sole discretion, to cancel or suspend this Sweepstakes should virus, bugs or other causes beyond the control of sponsor, corrupt the administration, security or proper play of the Sweepstakes. Any claims relating to this Sweepstakes shall be governed by New York law without regard to its conflict of law, rules, and any such claim must be heard in New York. Taxes, and shipping, handling and delivery fees, if any, are the sole responsibility of the prize winner. Participation in Sweepstakes and acceptance of prize constitutes each winner’s permission for Sponsor to use of his/her name, address (city and state), email address, photograph, biographical information, likeness and/or statements made by each winner regarding the Sweepstakes or Sponsor for advertising and future promotional purposes without notice or additional compensation (except where prohibited by law). This contest is subject to these complete and official rules and by entering each participant accepts and agrees to these rules. Entrants who do not comply with these Official Rules or attempt to interfere with this Sweepstakes in any way shall be disqualified.
